ALL DAY Photo Booth Rental. TERMS AND CONDITIONS
By renting from Winx Photobooth, you are agreeing to these terms and conditions. You are responsible for reading the entire document.
The following terms and conditions set forth an agreement between the renter and Winx Photobooth for drop-off photo booth services for the event. This written agreement outlines the full intention of both parties and supersedes all other written and/or oral agreements.
By renting from Winx Photobooth, you are agreeing to these written terms and conditions.
TERMS
1.Connectivity & Delivery of Photos:
•All images from the photo booth are sent via WiFi/LTE connection. Photo delivery to guests may be delayed if the connection is lost or weakened. Once a strong connection is established, all photos will be sent.
•The quality of photos is subjective and not grounds for refunds. All equipment provided is industry standard for novelty photo booth rental services.
2.Rental Period:
•Rentals are available between 11 AM and 11 PM.
3.Liability:
•Any misuse of equipment (including props, backdrops, or the stand) by the client or their guests, including children, that results in damage or harm, is the sole responsibility of the client or said person.
•Winx Photobooth is not liable for any guest actions during the rental period.
PAYMENT
1.Reservation Deposit:
•A non-refundable $99 deposit is required to reserve the photo booth.
•Full payment must be made prior to the event date. Service will not be provided without complete payment.
2.Additional Hours:
•Extra rental hours, if needed, must be paid in full before they are provided. Unscheduled extra time will be accommodated only if possible and must be paid on-site via electronic payment or cash.
3.Parking Fees:
•Any parking fees required for delivery and setup must be covered by the client and included in the final invoice. Failure to pay may delay service.
DATE CHANGES, CANCELLATIONS, AND REFUNDS
1.Deposit:
•The $99 deposit is non-refundable under any circumstances.
2.Date Changes:
•Requests for a date change must be made at least 30 days in advance and are subject to availability. If the booth is unavailable for the new date, payments will be refunded minus the $99 deposit and applicable cancellation fees.
3.Cancellations:
•Cancellations up to 15 days before the event date are subject to a $100 cancellation fee.
•Cancellations one week or less before the event date are subject to a $150 cancellation fee.
•Cancellations due to insufficient or incorrect space, or refusal of access upon delivery, will not be refunded.
•Refunds for any upgrades or add-ons are subject to a $20 cancellation fee per item.
4.Unforeseen Circumstances:
•If Winx Photobooth cannot render services due to unforeseen circumstances, all prior payments will be fully refunded.
5.Chargebacks:
•Chargeback requests without first contacting Winx Photobooth will be resolved in small claims court.
DAMAGE TO EQUIPMENT
1.Responsibility:
•Clients are financially responsible for any accidental damage or loss of equipment during the rental period.
•The replacement cost for equipment is $3,000 plus compensation for lost business.
2.Causes of Damage:
•Damage caused by misuse, theft, disasters (e.g., rain, fire, flood), outdoor setup without covering, or vandalism is the client’s responsibility.
•A $100 fee will be billed if the photo booth setup is moved by the client or guests.
INDEMNIFICATION
1.Client Responsibility:
•The client indemnifies Winx Photobooth and its associates against any liability arising from guest use or misuse of the photo booth, including injuries or damages caused by children.
•The client indemnifies Winx Photobooth against any claims related to photos taken at the event.
MODEL RELEASE
By renting from Winx Photobooth, you agree to the following:
1.Copyright:
•Winx Photobooth owns the copyright to all photos taken and reserves the right to use them for promotion, advertising, or other purposes.
•Clients may request, in writing, that photos be kept private.
2.Liability:
•Winx Photobooth is released from liability associated with the use of photos, including claims for libel or invasion of privacy.
MISCELLANEOUS TERMS
1.If any provision of these terms is deemed unlawful or unenforceable, the remaining provisions will remain in effect.
2.Disputes will be resolved via arbitration or small claims court.
3.This agreement constitutes the entire understanding between Winx Photobooth and the client.
